GENERAL TERMS AND CONDITIONS OF SALE

1. Subject of these Terms and Conditions.
These Terms and Conditions (the ""Conditions"") regulate the sales relations of the services (the ""Services"", as defined below) that can be purchased on the site www.adartem.it (the ""Site"") between the Site Owner and the User who uses the Site or purchases the Products on the Site.

2. Owner of the Site
The owner of the website referred to at www.adartem.it is Ad Artem S.r.l. (""Owner"" or ""Ad Artem""), with legal and administrative headquarters in Milan, via Lanzone 13, tax code and VAT number no. 11033950152, registered in the Milan business register under no. 3. Services for sale on the Site
The Site is a tool that allows the sale to the public of the following Services, created by Ad Artem s.r.l. in favor of its customers (natural persons and / or groups and / or legal persons, hereinafter the ""Customers""):
(i) Guided tours and educational services organized for customers in various museums and artistic sites, available in Italian or in other requested languages;
(ii) Voucher or gift certificate: a credit that can be purchased in advance and can be used for the purchase of a guided tour of the user's choice within 12 months of purchase;
(iii) Other activities (mainly laboratory activities) to be carried out at the applicant school's premises.

4. Procedure for purchasing the Services
Through the website www.adartem.it it is possible to access further pages that describe the Services relating to cultural proposals organized by Ad Artem, information relating to the time and place of meeting, the description of the Services included in the ticket price, the button for the purchase with the details of the rate, expressed in euros. To initiate the purchase order for one or more Services on the Site, the Customer must click on the ""Purchase"" button and follow the guided procedure for filling out the order form, which must be considered, for all legal purposes, as a contractual proposal formulated by the Customer towards Ad Artem which will express its acceptance according to the terms indicated in the following article 5. To complete the order form, the Customer must provide their personal data and payment details which will be processed in accordance with what is stated in the Privacy Policy available on the Site. Before proceeding with the purchase, you can enter any discount codes or voucher in the appropriate box. By clicking on the ""Continue"" button, the Customer expresses his acceptance of these Conditions of sale which can be reached from a link at the bottom of the home page of the Site.

5. Methods of payment
The Site uses third party services (Nexi Cartasi) for processing payments and, therefore, does not record credit card details (such as, by way of example: credit card number, name of the holder, date of validity). Should the owner of each of these third-party instruments refuse the payment authorization, the order form will not be completed and, therefore, the related purchase will not be completed.
The sending of the order form is considered sent and, therefore, the purchase of the related Services will be confirmed only upon receipt of the automatic confirmation e-mail from the adartem.it site containing the summary of the purchase. The purchase confirmation e-mail must be shown before the start of the visit or the activity purchased. No access ticket or ticket will be sent to the User's residence and / or domicile and / or residence address.

6. Withdrawal and refund
The Customer has the right to exercise the right of withdrawal within 14 days prior to the purchase of the tour / Service, with full refund of the amount paid, in compliance with the provisions of Legislative Decree no. 21/2014 which transposed Directive 2011/83 / EU on consumer rights. If the Customer, for serious and documented reasons, could not use the Services already purchased, he can submit a refund request by sending an e-mail to info@adartem.it containing the references of the purchase order. The Customer has the right to be re-credited to a bank account or, at the Customer's choice, to a bonus equal to the same value of the Services Purchased and which can be spent on the Site for the purchase of any Product.
The refund is equal to the price of the purchased product, except for any cancellation fees. The refund is total if the refund request is received at least 72 hours before the starting time of the guided tour. - The refund is equal to 50% of the product price if the refund request is received between 72 hours and 24 hours before the starting time of the guided tour. - There is no refund if the request is received within 24 hours prior to the date of the guided tour.

7. Cancellation of tours
The Services purchased on the Site may be canceled by Ad Artem due to particularly adverse weather conditions or due to force majeure. In this case, the Customers will be informed by e-mail and / or telephone and will be entitled to a full refund of the Service or, at the Customer's choice, to a bonus equal to the same value of the Purchased Services that can be spent on the Site for the purchase of any Service.

8. Copyright
All trademarks, figurative or nominative and all other signs, trade names, service marks, word marks, trade names, illustrations, images, logos that appear on the Site concerning Ad Artem are and remain the exclusive property of the Owner or its licensors. and are protected by current trademark laws and related international treaties. It is possible to reproduce the texts and trademarks of the Site by requesting the written authorization of Ad Artem s.r.l. by sending a request to info@adartem.it.

9. Treatment of personal data
Information on the processing of the Customer's personal data is shown on the page containing the Site's Privacy Policy.

10. Changes
Ad Artem reserves the right to modify or update these Terms and Conditions as a result of the introduction of new laws or regulations and to notify them on the Site. 11. Applicable law and competent court
These Terms and Conditions are subject to Italian law and in particular to Legislative Decree no. 206/2005 relating to distance selling and Legislative Decree no. 70/2003 regarding some aspects of electronic sales. For any and all disputes relating to this Agreement and / or the use of the Site or the purchase of the Services on the Site, the court of Milan will have exclusive jurisdiction.

12. Online Dispute Resolution
In accordance with Article 14 of Regulation (EU) no. 524/2013, the Data Controller informs Users that it is possible to resolve disputes out of court concerning contracts concluded with companies for the purchase of goods and services carried out online by connecting to the ODR telematic platform, which can be reached at https://webgate.ec.europa.eu/odr.

The Customer expressly declares to accept pursuant to and for the purposes of articles 1341 and 1342 of the Italian Civil Code the clauses referred to in art. 6 ""Withdrawal and Refund"", art. 7 ""cancellation of tours"" and art. 11 ""Applicable law and forum.
