GENERAL TERMS AND CONDITIONS OF SALE

 

1. Object of these Terms and Conditions
These Terms and Conditions (the "Terms") govern the sale of services (the "Services," as defined below) available for purchase on the website www.adartem.it (the "Site") between the Site owner and the User who uses the Site or purchases Products on the Site.

2. Site Owner
The owner of the website at www.adartem.it is Ad Artem S.r.l. ("Owner" or "Ad Artem"), with its registered office and administrative office at Via Lanzone 13, Milan, tax code and VAT number 11033950152, registered in the Milan Business Register under no. MI-1431500, with a share capital of €10,400.00. The Owner can be contacted at the email address info@adartem.it.

3. Services for sale on the Site
The Site serves as a platform for the public sale of the following Services, provided by Ad Artem S.r.l. for its clients (natural persons, groups, and/or legal entities, hereinafter referred to as the "Clients"):
(i) Guided tours and educational services organized for Clients at various museum and artistic locations, available in Italian or other requested languages;
(ii) Vouchers or gift certificates: a credit purchased in advance and redeemable for a guided tour of the User's choice within 12 months from the date of purchase;
(iii) Other activities (primarily workshops) to be conducted at the location of the requesting school.

4. Procedure for Purchasing Services
Through the site www.adartem.it, users can access additional pages describing the Services, including information on cultural proposals organized by Ad Artem, details regarding meeting times and locations, the description of Services included in the ticket price, and the purchase button with pricing details in euros. To initiate the purchase order for one or more Services on the Site, the Client must click on the "Purchase" button and follow the guided procedure for completing the order form. The order form constitutes, for all legal purposes, an offer made by the Client to Ad Artem, which will express its acceptance in accordance with the terms set out in Article 5 below. To complete the order form, the Client must provide personal information and payment details, which will be processed in accordance with the Privacy Policy available on the Site. Before proceeding with the purchase, it is possible to enter any discount codes or vouchers in the designated box. By clicking the "Continue" button, the Client accepts these Terms of Sale, which are accessible via a link at the bottom of the homepage of the Site.

5. Payment Methods
The Site uses third-party services (Nexi Cartasi) for payment processing, and therefore does not store credit card details (e.g., card number, cardholder's name, expiry date). If the third-party service provider refuses authorization for payment, the order form will not be completed, and the corresponding purchase will not be finalized.
The order form is considered submitted, and the purchase of the related Services will be confirmed only upon receipt of an automatic confirmation email from the site adartem.it, which will include a summary of the purchase. The confirmation email must be presented before the start of the tour or activity purchased. No entry tickets or vouchers will be sent to the User's home address and/or domicile.

6. Right of Withdrawal and Refund
The Client has the right to exercise the right of withdrawal within 14 days prior to the purchase of the tour/Service, with a full refund of the amount paid, in accordance with Legislative Decree no. 21/2014, which transposed Directive 2011/83/EU on consumer rights. If the Client, for serious and documented reasons, is unable to utilize the Services already purchased, they may request a refund by sending an email to info@adartem.it, providing the details of the purchase order. The Client is entitled to a refund to their bank account or, at the Client's choice, to a bonus equal to the value of the purchased Services, which can be used on the Site for the purchase of any Product.
Refunds are based on the price of the purchased product, excluding any cancellation fees. The refund is full if the refund request is received at least 72 hours before the scheduled start time of the guided tour. The refund is 50% of the product price if the refund request is received between 72 and 24 hours before the scheduled start time of the guided tour. No refund is available if the request is made within 24 hours of the scheduled start time of the tour.

7. Tour Cancellation
Services purchased on the Site may be canceled by Ad Artem due to adverse weather conditions or force majeure events. In such cases, Clients will be notified via email and/or phone and will be entitled to a full refund of the Service or, at the Client's choice, to a bonus equal to the value of the purchased Services, which can be used on the Site for the purchase of any Service.

8. Copyright
All trademarks, figurative or nominative, and all other signs, trade names, service marks, logos, illustrations, images, and logos appearing on the Site relating to Ad Artem are and remain the exclusive property of the Owner or its licensors and are protected by applicable trademark laws and international treaties.
Reproduction of texts and trademarks from the Site is permitted only with prior written consent from Ad Artem S.r.l. by sending a request to info@adartem.it.

9. Personal Data Processing
Information regarding the processing of the Client's personal data is provided on the Privacy Policy page of the Site.

10. Amendments
Ad Artem reserves the right to modify or update these Terms and Conditions, including in response to the introduction of new laws or regulations, and will notify Users of such changes on the Site. The updated Terms and Conditions will become effective from the date of publication on the Site, as indicated at the end of these Terms and Conditions.

11. Applicable Law and Jurisdiction
These Terms and Conditions are governed by Italian law, in particular Legislative Decree no. 206/2005 regarding distance sales and Legislative Decree no. 70/2003 concerning certain aspects of electronic sales. Any and all disputes relating to this Agreement and/or the use of the Site or the purchase of Services from the Site shall be exclusively subject to the jurisdiction of the courts of Milan.

12. Online Dispute Resolution
In accordance with Article 14 of Regulation (EU) No. 524/2013, the Owner informs Users that disputes regarding contracts concluded with businesses for the purchase of goods and services online may be resolved out of court by accessing the ODR platform at: https://webgate.ec.europa.eu/odr.

The Client expressly agrees, for the purposes and effects of Articles 1341 and 1342 of the Italian Civil Code, to the clauses set forth in Articles 6 ("Right of Withdrawal and Refund"), 7 ("Tour Cancellation"), and 11 ("Applicable Law and Jurisdiction").
